What Is DSS Landlord Insurance?
DSS landlord insurance is ordinary landlord cover from an insurer that accepts tenants receiving housing benefit or the housing element of Universal Credit.
The property is insured exactly as any other let. The only thing that changes is which insurers will quote and how they rate the tenancy.
Most UK landlord insurance policies ask about tenant type at quote, and answering that accurately is what puts the right insurers in front of you.

Can Landlords Refuse Tenants on Benefits?
No. Discriminating against prospective tenants because they are on benefits is now prohibited outright, and the same applies to tenants with children.
The legal position
The Renters’ Rights Act made this a statutory prohibition from 1 May 2026. Before that, county courts had already held that "no DSS" policies indirectly discriminated under the Equality Act 2010, because they disproportionately affect women and disabled people.
What you can still do
Assess affordability, take references and ask for a guarantor. Those are individual assessments rather than a category exclusion, and they are what insurers expect anyway.
Rent repayment orders raise the stakes
Getting this wrong now carries a heavier penalty. The maximum rent repayment order rose from one year of rent to two when the Act commenced.
Lender and insurer conditions
Some buy-to-let mortgages restrict tenant types, and some insurers decline them. Those are contractual positions between you and the provider rather than something you impose on applicants.
Advertising matters too
Adverts stating "no DSS", "no children" or "professionals only" now risk breaching the prohibition directly. Advertising must also carry an asking price, and inviting offers above it is banned.

How Does Housing Benefit Work in Practice?
Most new claims go through Universal Credit, where the housing element is normally paid to the tenant, with direct payment to landlords available in defined circumstances.

Local Housing Allowance caps
Rates are set by area and household size, and they frequently sit below market rent. The tenant funds any shortfall, so affordability should be assessed against the full rent.
Managed payments to landlords
Direct payment can be arranged where a tenant is in arrears or would struggle to manage their money. It is decided case by case, and it is worth applying for early rather than after arrears build.
Payment timing
Universal Credit is paid monthly in arrears, which can create a gap at the start of a tenancy. Planning for that gap prevents it being recorded as arrears.

What Should You Check Before the Tenancy Starts?
Affordability against the full rent, the payment route, the guarantor position, and whether your lender and insurer both accept the tenant type.
Affordability against the whole rent
Local Housing Allowance rarely covers a market rent in full. Work out what the tenant must fund themselves and whether their other income supports it.
How the housing element will be paid
Ask whether the tenant expects to receive it themselves or whether a managed payment is likely. It changes how you monitor the rent account.
Whether a guarantor is available
A guarantor strengthens both the tenancy and any rent guarantee application. It is the single change that most improves the insurance position.
Your lender’s conditions
Some buy-to-let mortgage conditions restrict tenant types. Letting in breach of them is a more serious problem than a declined insurance quote.
The first month gap
Universal Credit is paid monthly in arrears, so the first payment can arrive weeks after the tenancy starts. Agreeing how that gap is covered prevents it being logged as arrears.

The same exclusions as any landlord policy, plus anything arising from a tenant type you did not declare.

Undeclared tenant type
Insuring a property as let to working tenants when it is let on benefits is a misdescription. It is the most likely reason a claim on this kind of tenancy is refused.

As on any policy, gradual deterioration is a cost of ownership rather than a claim.

How Can You Make the Tenancy Work Well?
Reference properly, assess affordability against the full rent, seek direct payment where appropriate, and keep the insurer informed.
Reference the same way you would anyone
Affordability, previous landlord references and a guarantor where the income is tight. A benefit tenant with a guarantor and a good record is a better risk than an unreferenced professional.
Check affordability against the whole rent
Work from the full rent rather than the Local Housing Allowance figure. A shortfall the tenant cannot cover is where most arrears start.
Apply for managed payments early
Where the criteria are met, direct payment removes a large part of the risk. Applying at the first sign of difficulty is better than waiting.
Keep your landlord duties current

Keep the rent account clean
A dated rent statement showing every payment matters more where benefit timing is irregular. It is the document a rent guarantee claim or a possession case is built on.
Tell the insurer when things change
If a tenant moves into work, or the payment arrangement changes, update the policy. Accurate declarations are what keep the cover reliable.

What does DSS mean now?
It is an outdated reference to the former Department of Social Security. In practice it means a tenant receiving housing benefit or the housing element of Universal Credit, and the term persists in insurance and lettings even though the department no longer exists.
Can I refuse to let to tenants on benefits?
